This Privacy Policy outlines Agile Leadership Journey, LLC’s  (" we ", " our " or " the Company ") practices with respect to information collected from users who access our websites, platforms, or online workspaces, including but not limited to www.agileleadershipjourney.com, agile-leadership-journey.myflodesk.com, survey.agileleadershipjourney.com, petebehrens.com, our Google Workspace, and our Mural and Slack workspaces (collectively " Sites "), or otherwise share personal information with us (collectively: " Users "). Agile Leadership Journey, LLC acts as the data controller for personal information collected through the Sites and services described in this Policy. Processing of your personal information (meaning, any information which may potentially allow your identification with reasonable means; hereinafter " Personal Information ") is necessary for the performance of our contractual obligations towards you and providing you with our services, to protect our legitimate interests, and for compliance with legal and financial regulatory obligations to which we are subject. 

When you use the Sites, you consent to the collection, storage, use, disclosure and other uses of your Personal Information as described in this Privacy Policy.

We encourage our Users to carefully read the Privacy Policy and use it to make informed decisions.

Lawful Basis for Processing

For users located in the European Economic Area, United Kingdom, or other jurisdictions with similar data protection laws, we process your personal information on the following lawful bases:

Contractual necessity: We process personal information that is necessary to perform our contract with you or to take steps at your request before entering into a contract. This includes processing information related to your registration, program participation, assessment completion, and service delivery.

Legitimate interests: We process certain personal information where it is in our legitimate interests to do so and those interests are not overridden by your rights. This includes analyzing usage of our Sites to improve our services, maintaining the security of our systems, and communicating with you about services you have used.

Consent: Where we rely on consent as the basis for processing — including for marketing communications and for non-essential cookies and tracking technologies — we will obtain your consent before processing begins. You may withdraw consent at any time without affecting the lawfulness of processing carried out before withdrawal.

Legal obligation: We process personal information where necessary to comply with our legal obligations, including applicable data protection, financial, and regulatory requirements.



Nature of Personal Information Collected in Connection with Client Engagements: Where Agile Leadership Journey receives information about individuals through client engagements — such as leadership development programs, organizational assessments, or coaching services — that information is generally limited to professional information necessary for the engagement. This typically includes names, professional titles and roles, organizational hierarchy, division or business unit, and work contact information such as work email addresses. We do not request or require personal contact information such as personal phone numbers, personal email addresses, home addresses, or dates of birth in connection with engagement services. Clients and their organizations are responsible for ensuring that only information strictly necessary for the engagement is shared with Agile Leadership Journey.

We collect two types of data and information from Users. 

The first type of information is un-identified and non-identifiable information pertaining to a User(s), which may be made available or gathered via your use of the Sites (“ Non-personal Information ”). We are not aware of the identity of a User from which the Non-personal Information was collected. Non-personal Information which is being collected may include your aggregated usage information and technical information transmitted by your device, including certain software and hardware information (e.g. the type of browser and operating system your device uses, language preference, access time, etc.) in order to enhance the functionality of our Sites. We may also collect information on your activity on the Sites (e.g. pages viewed, online browsing, clicks, actions, etc.).

The second type of information Personal Information which is individually identifiable information, namely information that identifies an individual or may with reasonable effort identify an individual. Such information includes:

• Device Information: We collect Personal Information from your device. Such information includes geolocation data, IP address, unique identifiers (e.g. MAC address and UUID) and other information which relates to your activity through the Sites.
• Contact form information: When you submit a contact form on our Sites you will be asked to provide us certain details such as: full name; e-mail or physical address, and other information you may provide about the nature of your request and how we may assist you.
• Registration information: When you register to our Sites you will be asked to provide us certain details such as: full name; e-mail or physical address, and other information. 

We do not rent, sell, or share Users’ information with third parties except as described in this Privacy Policy.

We may use the information for the following:

• Communicating with you – sending you notices regarding our services, providing you with technical information and responding to any customer service issue you may have;
• To communicate with you and to keep you informed of our latest updates and services;
• To serve you advertisements when you use our Sites (see more under "Advertisements"); 
• To market our websites and products (see more under "Marketing"); 
• Conducting statistical and analytical purposes, intended to improve the Sites;
• To invoice or collect payments from you or your employer for our services;
• To interact with one of our licensed guides that is providing services to you;
• To improve, enhance, modify, add to, and further develop our services;
• To protect you, our partners, and others from fraud, malicious activity, and other privacy- and security-related concerns;
• To develop new services;
• To provide customer support to you or to partners, including to help respond to your inquiries related to our service or partners’ applications;
• In connection with business transactions, including M&A transactions;
• To investigate any misuse of our service or partners’ applications, including violations of ours or our partner’s terms of service, criminal activity, or other unauthorized access to our services; 
• For other notified purposes with your consent; or
• To derive inferences, such as inferring your location based on information you provide and information we receive from other sources.

In addition to the different uses listed above, we may transfer or disclose Personal Information to our subsidiaries, affiliated companies, subcontractors, and licensed guides.

In addition to the purposes listed in this Privacy Policy, we may share Personal Information with our trusted third party providers, who may be located in different jurisdictions across the world, for a number of business purposes: 

• With the provider of an application you are using and as directed by that partner (such as with another third party if directed by you);
• With our data processors and other service providers, partners, or contractors in connection with the services they perform for us or partners;
• Between and among our current and future parents, affiliates, subsidiaries and other companies under common control or ownership;
• As we believe reasonably appropriate to protect the rights, privacy, safety, or property of you, partners, our partners, us, and others;
• For any other notified purpose with your consent; or
• With your employer or one of our licensed guides.

We may also disclose information if we have good faith to believe that disclosure of such information is helpful or reasonably necessary to: (i) comply with any applicable law, regulation, legal process or governmental request; (ii) enforce our policies (including our Agreement), including investigations of potential violations thereof; (iii) investigate, detect, prevent, or take action regarding illegal activities or other wrongdoing, suspected fraud or security issues; (iv) to establish or exercise our rights to defend against legal claims; (v) prevent harm to the rights, property or safety of us, our users, yourself or any third party; or (vi) for the purpose of collaborating with law enforcement agencies and/or in case we find it necessary in order to enforce intellectual property or other legal rights.

We may also collect, use, and share Personal Information in an aggregated, de-identified, or anonymized manner (that does not identify you personally) for any purpose permitted under applicable law. This includes creating or using aggregated, de-identified, or anonymized data based on the collected information to develop new services and to facilitate research.

Purchase and Subscription Terms

By making a purchase through our Sites or subscribing to our services, you agree to provide accurate, current, and complete information about yourself as prompted by the purchase, registration, or other form. If you choose to purchase a subscription, you are responsible for canceling it at least thirty (30) days before the renewal date if you no longer wish to be charged. Failure to cancel constitutes your acceptance of the renewal and the corresponding charges. We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time, including availability, features, or content.

Requests for refunds will be made at the sole discretion of the Company.

You may request to: 

1. Receive confirmation as to whether or not personal information concerning you is being processed, and access your stored personal information, together with supplementary information. 
2. Receive a copy of personal information you directly volunteer to us in a structured, commonly used and machine-readable format. 
3. Request rectification of your personal information that is in our control.
4. Request erasure of your personal information. 
5. Object to the processing of personal information by us. 
6. Request to restrict processing of your personal information by us.
7. Lodge a complaint with a supervisory authority.

However, please note that these rights are not absolute, and may be subject to our own legitimate interests and regulatory requirements. 

Subject to certain limitations and exceptions, if you are a California resident, you may have the following rights with respect to Personal Information we have collected about you that constitutes personal information under the California Consumer Privacy Act (“CCPA”):

• To request access to more details about the categories and specific pieces of personal information we may have collected about you in the last 12 months (including personal information disclosed for business purposes).
• To request deletion of your personal information;
• To opt-out of any “sales” of your personal information, if a business is selling your information; and
• To not be discriminated against for exercising these rights.
•  To exercise your data protection rights, where applicable, you can submit a request by contacting us as described in the “How to Contact Us” section below. You may be required to provide additional information necessary to confirm your identity before we can respond to your request.

Rights of Users in the European Economic Area and United Kingdom

If you are located in the European Economic Area (EEA) or United Kingdom at the time your personal information is collected or processed by ALJ, you have the following rights under the General Data Protection Regulation (GDPR) or applicable UK data protection law:

• The right to access the personal information we hold about you and to receive a copy of it.
• The right to rectification of inaccurate or incomplete personal information.
• The right to erasure of your personal information in certain circumstances, including where the information is no longer necessary for the purposes for which it was collected.
• The right to restrict processing of your personal information in certain circumstances.
• The right to data portability, meaning the right to receive your personal information in a structured, commonly used, and machine-readable format where processing is based on consent or contractual necessity.
• The right to object to processing of your personal information where we rely on legitimate interests as the lawful basis.
• The right to withdraw consent at any time where we rely on consent as the lawful basis for processing, without affecting the lawfulness of processing carried out before withdrawal.

We will consider all such requests and provide our response within a reasonable period of time and within any time period required by applicable law. Please note, however, that certain information may be exempt from such requests — for example, if we need to keep the information to comply with our own legal obligations or to establish, exercise, or defend legal claims.

We will retain your personal information for as long as necessary to provide our services, and as necessary to comply with our legal obligations, resolve disputes, and enforce our policies. Retention periods will be determined taking into account the type of information that is collected and the purpose for which it is collected, bearing in mind the requirements applicable to the situation and the need to destroy outdated, unused information at the earliest reasonable time. Under applicable regulations, we will keep records containing client personal data, account opening documents, communications and anything else as required by applicable laws and regulations. 

We may rectify, replenish or remove incomplete or inaccurate information, at any time and at our own discretion. At the end of the applicable retention period, personal information is securely deleted or anonymized. We and our trusted partners use cookies and other technologies in our related services, including when you visit our Sites or access our services. Our use of cookies is governed by our Cookie Policy, which provides a full description of the cookies we use, their purpose, duration, and how to manage your preferences. A "cookie" is a small piece of information that a website assign to your device while you are viewing a website. Cookies are very helpful and can be used for various different purposes. These purposes include allowing you to navigate between pages efficiently, enable automatic activation of certain features, remembering your preferences and making the interaction between you and our Services quicker and easier. Cookies are also used to help ensure that the advertisements you see are relevant to you and your interests and to compile statistical data on your use of our Services. 

The Sites use the following types of cookies:

a. 'session cookies' which are stored only temporarily during a browsing session in order to allow normal use of the system and are deleted from your device when the browser is closed; 

b. 'persistent cookies ' which are read only by the Sites, saved on your computer for a fixed period and are not deleted when the browser is closed. Such cookies are used where we need to know who you are for repeat visits, for example to allow us to store your preferences for the next sign-in; 

c. 'third party cookies' which are set by other online services who run content on the page you are viewing, for example by third party analytics companies who monitor and analyze our web access.

Cookies do not contain any information that personally identifies you, but Personal Information that we store about you may be linked, by us, to the information stored in and obtained from cookies. You may remove the cookies by following the instructions of your device preferences; however, if you choose to disable cookies, some features of our Sites may not operate properly and your online experience may be limited. We use CookieYes as our consent management platform to obtain and record your consent preferences before non-essential cookies and tracking technologies are activated on your device. We use Google Analytics 4 (GA4) to collect information about your use of the Sites, including how often users visit, which pages they view, and general usage patterns. We use this information only to improve our Sites and services. IP anonymization is enabled in our GA4 configuration, meaning your full IP address is never stored or transmitted to Google. Event data collected through Google Analytics is retained for a period of 14 months before being automatically deleted. Google's ability to use and share information collected by Google Analytics about your visits to these Sites is restricted by the  Google Analytics Terms of Use and the Google Privacy Policy .

Third-Party Service Providers and Data Processors

We use the following third-party service providers to operate our Sites and deliver our services. These providers may process personal information on our behalf, and where required we have entered into data processing agreements with each of them to ensure your information is handled in accordance with applicable law.

AddCal — We use AddCal to deliver calendar invites to event and program registrants. When attendees register for ALJ events, their contact and event data may be transmitted to AddCal to generate and deliver calendar invitations. Anthropic PBC (Claude) — We use Claude, an AI assistant developed by Anthropic, for internal business operations including research, content development, and operational support. We do not input personal information of clients, participants, or other individuals into Claude. Anthropic's privacy policy is available at https://www.anthropic.com/privacy.

Authorize.Net (Visa) — We may use Authorize.Net to process payments made through our survey and assessment platform, however, this is not currently in use. Payment transaction data is processed by Authorize.Net as a PCI-compliant payment processor. Bill.com — We use Bill.com to manage accounts payable and vendor payment processing. Vendor contact and financial information may be processed through Bill.com in connection with these activities. Bill.com's privacy policy is available at https://www.bill.com/privacy-policy.

Calendly, LLC — We use Calendly to manage meeting scheduling for our team. When you schedule a meeting with an ALJ team member, your contact information and scheduling preferences are processed by Calendly. Calendly's privacy policy is available at https://calendly.com/legal/privacy-notice.

Common Ninja Ltd. — We use Common Ninja widgets to enhance the functionality and interactivity of our Sites. Common Ninja is headquartered in Israel and processes end-user data as a data processor on behalf of ALJ. Common Ninja's privacy policy is available at https://www.commoninja.com/privacy.

CookieYes — We use CookieYes as our consent management platform to manage cookie preferences on our Sites. CookieYes records your consent preferences and ensures that non-essential cookies are not activated without your consent. CookieYes's privacy policy is available at https://www.cookieyes.com/privacy-policy.

DigitalOcean, LLC — Our proprietary survey and assessment application is hosted on DigitalOcean's cloud infrastructure. Assessment and survey data collected through our application is stored on DigitalOcean servers. DigitalOcean's privacy policy is available at https://www.digitalocean.com/legal/privacy-policy.

Duda, Inc. — Our primary website is built and hosted on the Duda platform. Duda processes technical and usage data in connection with hosting our website. Duda's privacy policy is available at https://www.duda.co/legal/privacy-policy.

Duda, Inc. (E-commerce) — In addition to hosting our primary website, Duda powers our online store. When you make a purchase through our store, transaction data including contact and order information is processed through Duda's e-commerce platform. Duda's privacy policy is available at https://www.duda.co/legal/privacy-policy.

Flodesk, Inc. — We use Flodesk to manage email marketing communications. If you subscribe to our mailing list, submit a form on our Sites, or consent to receive marketing communications, your contact information will be stored in Flodesk and used to send those communications. You may unsubscribe at any time using the unsubscribe link in any email. Flodesk's privacy policy is available at https://flodesk.com/privacy.

Google LLC — We use Google Workspace for business operations, including email communication, calendar management, document creation and storage, team collaboration, and video conferencing via Google Meet. Google Meet sessions may include client and program participant interactions and, where recorded, those recordings are stored in Google Drive. We also use Google Analytics to analyze website traffic and usage patterns; data collected is anonymized and aggregated. All Google Workspace services are governed by Google's Workspace data processing terms. Where required, Google processes data under Standard Contractual Clauses for EU data transfers. Google LLC (Gemini) — Our Google Workspace subscription includes access to Gemini, Google's AI assistant. Where Gemini is used in connection with our services, it operates within our Google Workspace environment under Google's data processing terms. We do not use Gemini to process personal information of individuals outside of our organization's own workspace environment. HubSpot, Inc. — We use HubSpot as our customer relationship management platform. When you submit a form on our Sites, your contact information and form responses are transmitted to HubSpot and stored in our account. HubSpot is used to manage contact relationships, send communications, and track engagement with our services. HubSpot's privacy policy is available at https://legal.hubspot.com/privacy-policy.

Intuit Inc. (QuickBooks Online) — We use QuickBooks Online for accounting and financial management. Financial records including vendor and contractor payment information are processed through QuickBooks. Intuit's privacy policy is available at https://www.intuit.com/privacy/statement.

Mentimeter AB — We use Mentimeter to facilitate live audience engagement and interactive sessions during workshops and presentations. Participant responses submitted during sessions are processed by Mentimeter. Mentimeter stores customer data in the EU by default. Mentimeter's privacy policy is available at https://www.mentimeter.com/trust/legal/privacy-policy.

Mural — We use Mural as an online visual collaboration platform for leadership training and workshop delivery. Training content and participant contributions may be processed through Mural during facilitated sessions. Mural's privacy policy is available at https://www.mural.co/terms/privacy-statement.

Paperform — We use Paperform for certain forms and surveys hosted on our Sites. When you complete a Paperform form, your responses are transmitted to and stored by Paperform as a data processor on behalf of ALJ. Paperform is SOC 2 and GDPR compliant. Paperform's privacy policy is available at https://paperform.co/privacy/.

SendGrid (Twilio Inc.) — We use SendGrid to deliver transactional emails from our survey and assessment application, including account-related notifications and password resets. Email addresses are processed by SendGrid solely for this purpose. SendGrid is operated by Twilio Inc. Twilio's privacy policy is available at https://www.twilio.com/en-us/legal/privacy.

Slack Technologies, LLC — We use Slack for internal team communication and to operate community workspaces for program participants and alumni. Workspace member data including names, email addresses, and message content is processed by Slack. Slack is SOC 2 certified, ISO 27001 certified, and GDPR compliant. Site Search 360 — We use Site Search 360 to power search functionality on our Sites. When you use the search feature, your search queries may be transmitted to Site Search 360. Site Search 360's privacy policy is available at https://www.sitesearch360.com/privacy-policy.

Snowplow Analytics Limited — We use Snowplow for behavioral analytics and event tracking on our Sites. Snowplow's privacy policy is available at https://snowplow.io/privacy-policy.

Tockify — We use Tockify to display event calendars on our Sites. When you view our calendar, Tockify may process basic usage and technical data. Tockify's privacy policy is available at https://tockify.com/i/docs/company/privacy.

Typeform — We use Typeform for certain surveys hosted on our Sites. When you complete a Typeform survey, your responses are transmitted to and stored by Typeform. Typeform's privacy policy is available at https://www.typeform.com/help/a/typeform-privacy-policy-360029592951.

Virtualbadge.io (FutureNext GmbH) — We use Virtualbadge.io to create and issue digital certificates and badges to participants who complete our programs. When a certificate is issued, participant information including name and email address is transmitted to and processed by Virtualbadge.io to generate and deliver the digital credential. Virtualbadge.io is operated by FutureNext GmbH, a German company headquartered in Mannheim, Germany. Virtualbadge.io's privacy policy is available at https://www.virtualbadge.io/privacy-policy.

YouTube — Some pages on our Sites contain embedded YouTube video content. For EU visitors, YouTube embeds are blocked until consent is provided through our cookie consent tool. YouTube's privacy policy is available at https://policies.google.com/privacy.

Zapier, Inc. — We use Zapier to automate workflows and connect the applications and services we use to deliver our programs and operations. When workflows involve personal information such as contact details or form responses, that data is processed by Zapier as a data processor on our behalf. Zapier is SOC 2 Type II certified, GDPR compliant, and certified under the EU-US Data Privacy Framework. A Data Processing Addendum is incorporated into Zapier's Terms of Service. We may update this list as our service providers change. Material changes to our data processing relationships will be reflected in an updated version of this Privacy Policy.

Use of Artificial Intelligence Tools

Agile Leadership Journey uses artificial intelligence tools to support internal business operations including research, content development, writing assistance, and operational support. The AI tools we currently use are identified in our third-party service provider list above.

We do not use AI tools to make automated decisions about individuals that produce legal or similarly significant effects. AI tools are used by ALJ staff to support human decision-making, not to replace it.

We do not input client confidential information or personal information of clients, program participants, or other individuals into AI tools. AI tools at ALJ are used exclusively for internal operational purposes by ALJ staff.

Where AI tools are provided as part of our Google Workspace subscription — including Gemini — they operate within our Google Workspace managed environment and are subject to Google's Workspace data processing terms. Data entered into these tools within our Google Workspace environment is not used to train Google's AI models.

We will update this section as our use of AI tools evolves. Any material changes to how we use AI tools in connection with personal information will be reflected in an updated version of this Privacy Policy.

Our policy only addresses the use and disclosure of information we collect from you. To the extent you disclose your information to other parties or sites throughout the internet different rules may apply to their use or disclosure of the information you disclose to them. Accordingly, we encourage you to read the terms and conditions and privacy policy of each third party that you choose to disclose information to. 

This Privacy Policy does not apply to the practices of companies that we do not own or control, or to individuals whom we do not employ or manage, including any of the third parties which we may disclose information as set forth in this Privacy Policy. 

We take great care in implementing and maintaining the security of the Sites and your information. We employ industry-standard commercial practices to ensure the safety of the information we collect and retain, as well as to prevent unauthorized use of any such information. Although we take reasonable steps to safeguard information, we cannot be responsible for the acts of those who gain unauthorized access or abuse our Sites, and we make no warranty, express, implied or otherwise, that we will prevent such access.

Some of the third-party service providers we use are located in the United States. We rely on those providers to maintain appropriate legal safeguards for the transfer of personal data from the EEA, including participation in the EU-U.S. Data Privacy Framework or the use of Standard Contractual Clauses approved by the European Commission. A list of our third-party service providers and links to their privacy policies is available in the Third-Party Service Providers section of this policy.

We may use your Personal Information, such as your name, email address, telephone number, etc. ourselves or by using our third party subcontractors for the purpose of providing you with promotional materials concerning our services, which we believe may interest you. 

Out of respect to your right to privacy we provide you within such marketing materials with means to decline receiving further marketing offers from us. If you unsubscribe we will remove your email address or telephone number from our marketing distribution lists. 

Please note that even if you have unsubscribed from receiving marketing emails from us, we may send you other types of important e-mail communications without offering you the opportunity to opt out of receiving them. These may include customer service announcements or administrative notices.

We understand the importance of protecting children’s privacy, especially in an online environment. The Sites are not designed for or directed at children. Under no circumstances shall we allow use of our services by minors without prior consent or authorization by a parent or legal guardian. We do not knowingly collect Personal Information from minors. We reserve the right to periodically amend or revise the Privacy Policy; material changes will be effective immediately upon the display of the revised Privacy policy. The last revision will be reflected in the "Last modified" section. Your continued use of the Sites, following the notification of such amendments on our Sites, constitutes your acknowledgment and consent of such amendments to the Privacy Policy and your agreement to be bound by the terms of such amendments.
